Washington Public Records

Title 42 Chapter 42.56 RCW (the Washington State Public Records Act) was created to provide for the protection and public access to government records kept, gathered and maintained by the state of Washington for the purpose of carrying out its duties. In the law, 'public record' is defined as "any writing containing information relating to the conduct of government or the performance of any governmental or proprietary function prepared, owned, used, or retained by any state or local agency regardless of physical form or characteristics. For the legislature, 'public records' means "legislative records as defined in RCW 40.14.100. This includes all budget and financial records; personnel leave, travel, and payroll records; records of legislative sessions; reports submitted to the legislature; and any other record designated a public record by any official action of the senate or the house of representatives."
Exceptions:
Records are generally not considered public when their disclosure might 1) lead to an invasion of personal privacy, 2) hinder an active or open investigation, 3) endanger the public safety, 4) obstruct the regular function or operation of government, or 5) disclose proprietary corporate information that might lead to an unfair advantage. Aside from defining public and protected records, the law also mandates that each agency assign a Public Records Officer. It also mandates that requests must be responded to within 5 business days of receiving the request as well as provides options of action for a denied request. The Office of the Attorney General has provided a concise summary of how to obtain public records and what the recourse is for denied requests.
