Texas Public Records

The Texas Public Information Act (PIA), formerly known as the Texas Open Records Act (ORA), can be found in Chapter 552 of the Texas Government Code and outlines the rights and responsibilities of both the government and the public in regards to maintaining and accessing public records. Public information is generally defined as that information which is collected and/or created and/ or kept by the Texas government for the purpose of it's function and excludes certain documents that would infringe on personal privacy rights, might endanger individuals or government bodies, or otherwise hinder the function of the government or official proceedings (such as investigations). The Texas Attorney General creates annual publications to shed light on the PIA, and answer some of the more frequently asked questions: TX PIA Made Easy, and PIA Handbook. These publications are also available directly through the AG's Office.

Requesting Public Records:

In the State of Texas, in order for the law to be active, requests for public information MUST BE MADE IN WRITING. Further, requests should only be made for records that are already in existence as governmental bodies are not required to to perform legal research or comply with a perpetual request for periodic information as it comes into being. It is also recommended that requests be made via US Mail and that such requests be addressed to the attention of the Officer of Public Information (OPI) or Chief Administrator (CA) for that agency. If you fax or email your request, it must be addressed to the OPI or CA of that agency in order for the PIA to be invoked, otherwise, the agency is under no obligation to fulfill your request.

Every TX agency is required to clearly post a sign that amounts to a "PIA Bill of Rights" in order to further facilitate the proper invocation of the law.
