South Dakota Public Records

The South Dakota Public Access to Records statute can be found in Chapter 1-27 of the SD Code. For a list of what is specifically protected under SD statute, please click here.  Other records that are NOT public include those that contain certain financial, commercial, personal correspondence and certain court actions. Further, the state may decide to omit or otherwise black out (redact) information  considered an infringement on personal privacy contained in otherwise public records. 

1-27-42 defines the public record officer for keeping and maintaining records within an agency, county or local entity:

  • Counties:
    • the county auditor or the custodian of the record for law enforcement records.
  • First or second class municipalities:
    • the finance officer or the clerk or the custodian of the record for law enforcement records.
  • Third class municipalities:
    • the president of the board of trustees or the custodian of the record for law enforcement records.
  • Organized townships:
    • the township clerk.
  • School districts:
    • the district superintendent or CEO.
  • Special districts:
    • the chairperson of the board of directors.
  • Entities not otherwise designated above:
    • the person who acts in the capacity of the chief financial officer or individual as designated by the entity.
