New Jersey Public Records

The Open Public Records Act of New Jersey  (OPRANJ) provides definitions and exemptions for what does and does not constitute public records and provides requirements for managing, maintaining and releasing public information, as well as outlines the rights and responsibilities of all parties involved.  In this law, 'public record' is defined as any and all government records in whatever form they exist that are not otherwise protected by this or any other federal or state statutes.

Exemptions to public record include but are not limited to:

  • Legislative records-  information received by a legislator either from or regarding a constituent or any memorandum, notes, correspondence, report or other communication used by the legislature or legislators  for any purpose unless the release is mandated by law.
  • Medical Examiner records- any and all documentation or reproduction of record taken at the scene or during post mortem examination or autopsy whether made by the ME or on their behalf UNLESS record is to be used by prosecutors or law enforcement for criminal action or active investigation activity that relates to the subjects death or for use by authorized forensic pathologists either for medical or scientific education or research.
  • Criminal Investigation Records
  • Victims records - except when requested by the victim or the victim's legal representative.
  • Trade secrets and proprietary information
  • Information of a personal and private nature   including student or medical records (all types) as well as state employee or agency personnel records where personal contact information is included, tax records, assets/ holdings records, etc.

Government Records Council is the enforcement and citizen advocate agency formed in conjunction with OPRA. It is the responsibility of the GRC to inform the public and public records custodians to the latest best practices for requesting, maintaining and delivering public records.  In order to do this, issue public announcements, maintain a toll free hotline and website, issue advisory opinions, deliver training to records custodians, provide mediation and resolve disputes.
